Refund Policy — RocketVPN

Refund Policy of Xenex Networks LLC d/b/a RocketVPN, including dispute resolution and pre-litigation claim procedure.

This Refund Policy (the "Policy") forms part of the Terms of Service between you and Xenex Networks LLC, a Delaware limited liability company doing business as RocketVPN ("RocketVPN", "we", "us"). By registering an account, activating a subscription, or otherwise using the Service, you acknowledge that you have read, understood, and accepted this Policy together with our Terms of Service and Privacy Policy.

1. Finality of Payments

All payments made to RocketVPN are final and non-refundable, regardless of the reason for cancellation, dissatisfaction, change of mind, technical inability to use the Service, partial use of the subscription term, or any other circumstance. By completing payment you expressly waive any right to a chargeback, refund, or reversal except as required by applicable law.

Before paying, every user has the opportunity to evaluate the Service through our free trial period and through our published technical specifications and setup guides. We strongly encourage you to use the free trial to confirm that the Service meets your requirements prior to purchasing a paid subscription.

2. Statutory Exceptions

Nothing in this Policy is intended to limit any non-waivable refund right that may be granted to you by mandatory consumer-protection legislation of the United States, the State of Delaware, or the country of your habitual residence to the extent such legislation applies to digital services delivered cross-border. Where such law grants you a statutory refund right, we will honor that right strictly within the scope, time limits, and procedures set out in the applicable statute.

3. Technical Support Before Refund Request

If you experience difficulty connecting to or configuring the Service, please first contact our technical support team at support@rocketvpn.net. The overwhelming majority of issues are resolved with assistance from our agents within a single support session.

4. Dispute Resolution & Pre-Litigation Claim

If you believe that our refusal to issue a refund violates a law applicable to you, the parties shall first attempt to resolve the matter through the pre-litigation claim procedure set out below. Submission of a properly formatted pre-litigation claim is a mandatory condition precedent to any formal court action.

4.1. How to Submit a Pre-Litigation Claim

A written pre-litigation claim must be delivered by registered mail (with confirmation of delivery) or by a comparable trackable courier service to our Delaware mailing address:

4.2. Required Content of the Claim

To be deemed validly submitted, the claim must include each of the following elements:

Claims that omit any of the required elements may be returned to the sender with a request to correct the deficiency.

4.3. Our Review & Response

Upon receipt of a complete pre-litigation claim at the address above, we will review the claim and issue a written response within the time period prescribed by applicable United States federal and Delaware state law. If the claim is found to be legally well-founded, we will resolve the dispute out of court by issuing the corresponding refund or other relief. If the claim is found to be without legal merit, we will explain the basis of our decision in writing and reserve all rights to defend the position in court.

4.4. Judicial Proceedings

If pre-litigation resolution is not achieved, the dispute shall be resolved exclusively by the state or federal courts located in New Castle County, Delaware, USA, in accordance with Section 12 of our Terms of Service (Governing Law and Jurisdiction). Each party shall bear its own attorneys' fees and costs, except as otherwise provided by statute.

5. Chargebacks & Payment-Network Disputes

Initiating a chargeback with your card issuer or payment provider in lieu of following the pre-litigation procedure set out in Section 4 constitutes a breach of these terms. We reserve the right to (a) suspend or terminate the account, (b) recover the disputed amount together with any chargeback fees imposed on us by the payment network, and (c) pursue any remedy available under applicable law.
